Earlier Death was defined as “Complete & Irreversible cessation of spontaneous Cardiac and Respiratory functions. American Academy of Neurology in 1995, first time defined Brain Death as “Irreversible cessation of function of the Brain, including the brainstem.” Declaration of Death by Brain Stem Death criteria has been given a legal recognition in India only in context of Transplantation of Human Organs and Tissues Act, 1994 (THOTA). It is very important to understand the difference between severe Brain Damage and Brain Death. Brain death means life support cannot bring back meaningful life. Brain Death is the principal requisite for Organ donations for transplantation. Due to paucity of availability of organs, there is a long wait list for organs by needy patients in India.
